- [Penelitian yuridis normatif ini dengan menggunakan data utama UU No 25 Tahun 2007 Tentang Penanaman Modal berikut peraturan pelaksanaannya dan UU No 4 Tahun 2009 Tentang Pertambangan Mineral Dan Batubara berikut peraturan pelaksanaannya. Permasalahan yang diangkat dalam penelitian yang dilakukan yaitu mengenai kepastian hukum PMA bidang usaha pertambangan dan pemberian perijinan dalam rangka PMA bidang usaha pertambangan. Teori yang digunakan yaitu dari Lawrence M. Friedman yang berkaitan dengan substance, structure dan legal culture. Kepastian hukum atas regulasi berkaitan dengan penanaman modal asing bidang usaha pertambangan minerba yang ada dilihat dari aspek predictability, stability dan fairness. Bagaimana pula dengan kewenangan serta koordinasi dalam rangka pemberikan perizinan usaha pertambangan minerba, seperti izin investasi, pendirian perusahaan PMA dan pemberian izin usaha pertambangan (IUP), izin usaha jasa pertambangan (IUJP) dan izin usaha lainnya yang diperlukan. <hr> <b>Abstract</b><br> This normative juridical research using primary data of Regulation No. 25 Year 2007 about the Investment and its implementing regulations of Regulation No. 4 Year 2009 about the Mining Minerals and Coal and its implementing regulations. Issues raised in research conducted on the legal certainty of the FDI area of mining and the provision of licensing in order FDI field of mining. The theory used is from Lawrence M. Friedman relating to the substance, structure and legal culture.
