Transportasi laut memiliki peran penting dalm perekonomian, sehingga
diperlukan undang-undang yang mengaturnya, untuk menjamin pelayaran yang
tertib dan teratur. UU Nomor 17 Tahun 2008 tentang Pelayaran adalah undangundang
administrasi yang memiliki sanksi pidana. Penggunaan hukum pidana
dalam hukum administrasi merupakan masalah kebijakan hukum pidana.
Kebijakan hukum pidana dilihat secara fungsional, terdapat tiga tahap dalam
bekerjanya hukum pidana yaitu tahap formulasi, tahap aplikasi dan eksekusi.
Tahap formulasi atau disebut juga tahap kebijakan legislatif merupakan tahap
yang paling strategis karena pada tahap tersebut suatu perbuatan ditetapkan
menjadi tindak pidana. Undang-Undang Nomor 17 Tahun 2008 tentang Pelayaran
memuat perbuatan-perbuatan yang diancam dengan sanksi administratif serta
sanksi pidana, dan beberapa tindak pidana tersebut sebenarnya bukanlah
perbuatan-perbuatan yang karena pada dasarnya bertentangan dengan kewajaran,
moral dan prinsip umum masyarakat beradab (mala in se, natural crime),
sehingga penetapan perbuatan-perbuatan tersebut menjadi tindak pidana di dalam
Undang-Undang Nomor 17 Tahun 2008 tentang Pelayaran merupakan
overcriminalization. Penelitian ini untuk menjawab pertanyaan bagaimanakah
konsep kriminalisasi di dalam UU Nomor 17 Tahun 2008 tentang Pelayaran,
apakah hukum pidana benar-benar merupakan ultimum remidium. Apakah
kriminalisasi dalam UU Nomor 17 Tahun 2008 tentang Pelayaran menyebabkan
overcriminalization. Penelitian ini merupakan penelitian yuridis normatif. Dari
hasil penelitian didapatkan bahwa UU Nomor 17 Tahun 2008 tentang Pelayaran
tidak memiliki konsep yang jelas dalam penggunaan hukum pidana sebagai
ultimum remidium. Pasal-pasal di dalam Undang-Undang Nomor 17 Tahun 2008
tentang Pelayaran yang dapat digolongkan sebagai overlapping offenses/crimes,
adalah Pasal 291, 316, 324, 325, dan 326. Pasal-pasal di dalam Undang-Undang
Nomor 17 Tahun 2008 tentang Pelayaran yang dapat digolongkan sebagai crimes
of risk prevention, yaitu Pasal 286, 294, 302, 303, dan 323. Perlu dilakukan revisi
terhadap Undang-Undang Nomor 17 Tahun 2008 tentang Pelayaran, dengan cara
memasukkan Pasal 316 ke dalam KUHP, melakukan dekriminalisasi terhadap
Pasal 324, 325, dan 326, serta melakukan depenalisasi terhadap pasal-pasal
lainnya.

Sea transport has an important role economic performance, so we need laws that
govern it, to ensure the orderly and regular shipping. Shipping Act 2008 No. 17
on the voyage is the administrative laws that have criminal penalties. The use of
penal law to enforcement of administrative law is penal law policy?s problem. Penal
law policy can be seen from functional aspect. There are three steps in penal law
processing i.e. formulation, application and execution. Formulation step or known as
legislative policy is the most strategic step because in this step, a behavior is set to
be a criminal act. Shipping Act 2008 No. 17 on the voyage to load acts punishable
with administrative sanctions and criminal penalties, and some are in fact criminal
acts that are not as fundamentally at odds with fairness, morals and general
principles of civilized society (mala in se, natural crime), so the determination of
the acts are a criminal offense in the Shipping Act 2008 No. 17 on a voyage
overcriminalization. This research to answer the question how the concept of
criminalization in the Shipping Act 2008 No. 17 on the voyage, whether criminal
law is really a ultimum remidium. Is the criminalization of the Shipping Act 2008
No. 17 on the voyage causing overcriminalization. This research is a normative
juridical research. From the result showed that Shipping Act 2008 No. 17 on the
voyage did not have a clear concept in the use of criminal law as an ultimum
remidium. The articles in the Shipping Act 2008 No. 17 on the voyage that can be
classified as overlapping offenses / crimes, is Article 291, 316, 324, 325, and 326.
The articles in the Shipping Act 2008 No. 17 on the voyage that can be classified
