Tesis ini membahas upaya perlindungan hukum terhadap isteri yang
menjadi korban kekerasan dalam rumah tangga yang dilakukan oleh suami.
Penelitian ini bertujuan memperoleh pemahaman tentang perlindungan hukum
terhadap isteri yang menjadi korban tindakan kekerasan suami. Faktor penyebab
terjadinya kekerasan ini disebabkan karena faktor kepedulian keluarga dan
lingkungan, faktor budaya, faktor penegakan hukum, faktor ekonomi, faktor
kepribadian suami. Peranan petugas penegak hukum dalam melindungi hak-hak
perempuan telah dimulai sejak ditemukannya kasus kekerasan ke petugas
kepolisian hingga saat pemeriksaan di pengadilan. Diawali dari lembaga
Kepolisian yang menerima pengaduan tentang adanya tindak kekerasan, untuk
melindungi korban yang melaporkan kekerasan yang dialaminya. Setelah proses
melapor, polisi membuat berkas perkara yang kemudian akan dilimpahkan ke
kejaksaan. Kemudian kejaksaan akan membuat dakwaan dan tuntutan yang
akhirnya akan diputus oleh hakim di Pengadilan. Kejaksaan memiliki peran yang
sangat penting dalam proses penegakan hukum pidana, karena dapat tidaknya
perkara pidana masuk ke pengadilan adalah tergantung sepenuhnya oleh
Kejaksaan (Penuntut Umum). Peranan seorang hakim dalam melindungi hak hak
perempuan adalah memberikan keadilan kepada korban maupun terdakwa dalam
hal kasus tersebut telah diperiksa oleh pengadilan. Dalam memberikan keadilan
bagi korban dan terdakwa, hakim juga melihat unsur penyesalan dari terdakwa,
sehingga hakim tidak semata-mata berpatokan kepada tuntutan jaksa dan ancaman
pidana tetapi dengan memperhatikan sikap, kelakuan terdakwa selama
pemeriksaan, apakah terdakwa sudah berlaku baik atau tidak, apakah ada
penyesalan atau tidak sehingga penjatuhan putusan tidak semata mata untuk
menghukum tetapi memberi pelajaran agar tidak mengulangi lagi perbuatannya.
Dalam upaya memberikan perlindungan hukum terhadap isteri yang menjadi
korban tindakan kekerasan suami ditemukan beberapa kendala. Kendala tersebut
diantaranya disebabkan oleh faktor hukumnya sendiri, faktor petugas penegak
hukum, faktor sarana dan fasilitas, faktor masyarakat, faktor budaya

<b> Abstract </b><br>
This thesis discusses the legal safeguards against wives who are victims of
domestic violence committed by husbands. This study aims to gain an
understanding of legal protection for his wife who become victims of violent
husbands. Factor contributing to the violence is due to family concerns and
environmental factors, cultural factors, law enforcement factors, economic factors,
personality factors husband. The role of law enforcement officers in protecting
women's rights have been initiated since the discovery of cases of violence to the
police officer until the time of examination in court. Starting from police agencies
that receive complaints about abuses, to protect victims who report mistreatment.
After the report, the police make a case file will then be handed over to
prosecutors. Then the prosecutor will make the charges and demands that will
eventually be decided by the judge in court. Attorney has a very important role in
the process of criminal law enforcement, because whether or not a criminal case
goes to trial is dependent entirely by the Attorney (prosecutor). The role of a judge
in protecting women's rights is to give justice to the victim and the defendant in
this case has been examined by the court. In delivering justice for victims and
defendants, judges also look at elements of the defendant's remorse, so the judge
does not merely adhere to the demands and threats of criminal prosecution, but
noted the attitude, behavior of the defendant during the examination, whether the
defendant had a good effect or not, are there any regrets or not so that the
imposition of a decision not to punish but purely to give a lesson to not repeat his
actions. In an effort to provide legal protection for his wife who become victims
