  • [<b>ABSTRAK</b><br> Tesis ini membahas perlindungan hukum terhadap whistleblower kasus tindak pidana korupsi berdasarkan Undang-Undang Nomor 13 Tahun 2006 tentang Perlindungan Saksi dan Korban. Penelitian tesis ini adalah penelitian ualitatif dengan metode pendekatan yuridis normative dengan disain deskriptif analisis. Penelitian dilatarbelakangi banyaknya whistleblower kasus korupsi yang dikriminalisasi dengan pidana yang melibatkan dirinya terutama pencemaran nama baik, selain itu banyak kasus whistleblower yang mendapat ancaman secara fisik oleh pihak-pihak yang dilaporkan atau diungkapkan ke publik. Kriminalisasi dan intimidasi terhadap whistleblower disebabkan karena Undang-Undang Nomor 13 Tahun 2006 tentang Perlindungan Saksi dan Korban tidak memberikan landasan hukum yang kuat dalam upaya memberikan perlindungan hukum bagi pengungkap fakta (whistleblower) terutama yang terlibat dalam tindak pidana. Perlindungan terhadap whistleblower secara eksplisit diatur dalam Undang-Undang Nomor 13 Tahun 2006 pada Pasal 10 Ayat (1) dan Ayat (2), yang dinilai bertentangan dengan semangat whistleblower, karena pasal ini tidak memenuhi prinsip perlindungan terhadap seorang whistleblower, dimana yang bersangkutan tetap akan dijatuhi hukuman pidana bilamana terlibat dalam kejahatan. Dalam Undang-Undang Nomor 13 Tahun 2006 tentang Perlindungan Saksi dan Korban menunjukkan bahwa yang menjadi sasaran utama dalam upaya perlindungan hukum dalam proses penegakkan hukum pidana adalah hanya terhadap saksi dan korban, sehingga whistleblower (peniup peluit) yang berhak mendapat perlindungan hukum harus memenuhi kualifikasi sebagai saksi, yaitu apa yang diungkapkan ke publik adalah suatu perkara pidana yang ia dengar sendiri, ia lihat sendiri, dan/atau ia alami sendiri. Sedangkan yang hanya memenuhi kualifikasi sebagai pelapor, maka perlindungan yang diberikan berdasarkan pada Undang-Undang Nomor 31 Tahun 1999 tentang Pemberantasan Tindak Pidana Korupsi. <hr> <b>ABSTRACT</b><br> This thesis discusses the legal protection of the whistleblower cases of corruption based on Law No. 13 of 2006 on Protection of Witnesses and Victims. This thesis research is qualitative research methods with normative juridical approach to the design of descriptive analysis. Research background of many whistleblower cases of corruption are criminalized by the criminal himself chiefly involving defamation. In addition, there are many cases of whistleblowers who receive physical threats by those who report or disclose to the public.Criminalization, and intimidation against whistleblowers is because Act No. 13 of 2006 on Protection of Witnesses Victims do not provide a strong legal basis in an effort to provide legal protection for expressing facts (whistleblower) mainly involved in the crime. Protection against whistleblowers is explicitly regulated in Law Number 13 Year 2006 on Article 10 Paragraph (1) and Paragraph (2), which is considered contrary to the spirit of the whistleblower, as this article does not satisfy the principle of protection against a whistleblower, which is concerned remains to be convicted criminal when engaged in crime.
