Fenomena Notaris memperoleh panggilan dari penyidik Polri, penuntut umum
atau hakim semakin sering terjadi dalam proses peradilan pidana. Pada umumnya,
ketentuan-ketentuan dalam Kitab Undang - Undang Hukum Pidana (KUHP) yang
disangkakan dan dapat digunakan oleh penyidik, penuntut umum maupun hakim
untuk menetapkan seorang Notaris menjadi tersangka, terdakwa dan selanjutnya
menjatuhkan pidana adalah Pasal 55 sampai dengan Pasal 62 KUHP tentang
penyertaan dalam melakukan perbuatan pidana, dihubungkan (di-juncto-kan)
dengan perbuatan pidana atau delik itu sendiri. Meskipun sering digunakan dalam
proses peradilan pidana terhadap Notaris, pada kenyataannya ketentuan tentang
penyertaan dalam KUHP maupun Undang – Undang Jabatan Notaris (UUJN)
tidak memberi penjelasan yang memadai mengenai hal tersebut. Mengingat fokus
penelitian adalah penerapan ajaran penyertaan melalui pendekatan UUJN dengan
melakukan studi kasus terhadap putusan hakim, maka penelitian ini dilakukan
dengan cara eksplanatoris. Penelitian menghasilkan beberapa temuan pokok,
sebagai berikut: pertama, agar seseorang dapat dipidana sebagai peserta tindak
pidana ia harus memenuhi persyaratan penyertaan serta unsur kesalahan dan
pertanggungjawabannya tidak tergantung pada dipidana atau tidak dipidananya
pelaku utama; kedua, perbuatan Notaris yang memenuhi kriteria sehingga dapat
dikategorikan sebagai peserta dalam suatu tindak pidana hanya mengakibatkan
Notaris dipidana sama dengan pelaku tindak pidana. Namun demikian, perbuatan
tersebut tidak secara serta merta berimplikasi pada akta yang dibuat oleh Notaris
dalam mewujudkan penyertaan dalam tindak pidana. Perbuatan tersebut baru
dapat berimplikasi pada akta Notaris apabila persyaratan dalam UUJN tidak
terpenuhi dalam pembuatan akta, dimana akta yang dibuat adalah tidak otentik
dan hanya mempunyai kekuatan seperti akta yang dibuat di bawah tangan

<b>ABSTRAK</b><br>
Notorious phenomenon of Notary receiving summons to appear before Police
investigator, prosecutors or judge has been increasing in the criminal justice
system. In general, the provisions in the Penal Code (KUHP) imposing by the
investigator, prosecutor or judge, to determine a Notary to be a suspect, the
accused, and further to sentence them on an act of crime are Article 55 to Article
62 KUHP concerning participation in doing an act of crime, in conjunction to
(juncto) the predicate crime. Eventhough, those article are often used, KUHP and
the Law of Notarial Function (UUJN) gives insufficient explanation on such
matter. Considering the focus on this research is the application of theory of
participation based on UUJN by examining a judge’s decision, thus, this research
will use explanatory method. The research gives several findings such as: first, to
accuse a person as a participant of a crime, he/she must fulfill the requirements of
participation, moreover, the elements of fault and his/her responsibility is not
depend on whether the perpetrator is guilty; second, an act of a Notary that meet
the requirements as a participant in a crime shall only cause the Notary to be
accused equally with the perpetrator. However, such act does not automatically
affect the Notarial Deed. It can only be implied to a Notarial deed, only if, the
Deed does not drafted in accordance with the requirementsunder UUJN, namely,
the deed does not made in a notarial form which can only be equalized to a non
