A rule certainly contains legal ob- jectives: justice, benefit and legal certainty. This research aims to review the granting of Parole rights to recidivists using Jeremy Bentham's theory of utilitarianism. The research was carried out by applying normative legal research methods through statute approach and literature study. It is known that in general recidivists can be granted their parole rights if they fulfill the specified requirements and that parole cannot be granted if it has been previously revoked twice. Granting the parole rights does not only impact prisoners but also impacts other related parties such as families, guarantors, the community and probation officers. The result of the calculation shows that the total level of pleasure is higher than the pain that occurs upon the granting of parole for recidivists. This is in accordance with the principle of greatest happiness of the greatest number. However, the pleasure produced is more biased towards one party and not all parties get the same pleasure so testing and updates are needed regarding the rules granting the right to parole for recidivists/repeat offenders in order to maximize the pleasure and pain obtained. [ Narapidana residivis dapat menerima hak pembebasan bersyaratnya apabila telah memenuhi persyaratan sebagaimana diatur dalam Permenkumham No. 3 Tahun 2018. Sebuah aturan tentunya memuat tujuan hukum: keadilan, kemanfaatan, dan kepastian hukum. Penelitian ini bertujuan untuk meninjau pemberian hak Pembebasan Bersyarat bagi residivis dengan menggunakan teori utilitar- ianisme dari Jeremy Bentham. Penelitian ini dilakukan dengan menerapkan metode penelitian hukum normatif melalui pendekatan undang-undang dan studi kepustakaan. Diketahui bahwa secara umum residivis dapat diberikan haknya apabila memenuhi persyaratan yang telah ditentukan dan tidak dapat diberikan apabila telah dilakukan pencabutan sebanyak dua kali. Pemberian hak Pembebasan Bersyarat bukan hanya berdampak kepada narapidana melainkan juga berdampak terhadap pihak lain yang terkait seperti keluarga, penjamin, masyarakat, dan Pembimbing Kemasyarakatan. Hasil perhitungan menunjukkan bahwa total tingkat keseluruhan pleasure (kesenangan) lebih tinggi dibandingkan dengan pain (rasa sakit) yang ditimbulkan dari pemberian hak pembebasan bersyarat bagi residivis. Hal ini sesuai dengan prinsip the greatest happiness of the greatest number.
