  • Man likes to break the law, one of them is drug abuse. It does not become a local or national problem, but it is now globalized. In the 1990’s, the drug users comprised of all walks of life, the upper, middle, and lower classes of people. The research used combination method: judicial normative method and judicial empirical method so that it could find the solution of the problems between the regulations which supported the implementation of the rehabilitation and the practice in the field. Since it was normative, it used legal provisions approach and as it was empirical, it used interviews with informants and with respondents. Law No. 35/2009 on Narcotics gives the authority to a judge who examines drug addicts to order them to be under medical treatment and/or rehabilitation if they are not guilty of doing criminal act. The drug addicts who have been found guilty will be punished and treated and/or rehabilitated in Penitentiary of Narcotics. Rehabilitation is intended to implement the development of drug prisoners which is based on Law No. 12/1995 on Penitentiary. The stages of prisoner development are based on the Circular Letter No.KP.10.13/3/1 on February 8, 1965 on Penitentiary as the Process. The scope of prisoner development is based on the Decree of the Minister of Justice RI No: M.02.PK.04.10/1990 on the Pattern of Prisoner/Detainee Development. Rehabilitation is part of development system which is used to help a person release from addiction and to change his bad behavior. The stages of rehabilitation of drug users in the Penitentiary of Narcotics Class IIA, Pematangsiantar emphasize on physical and mental rehabilitation. The physical rehabilitation is intended that drug prisoners can be normal which means that they can be independent and maintain their ability or skill. They are made busy so that they will forget their dependency on drugs. They will be actively in sports, skills, while mental rehabilitation is implemented by performing training, guidance, and lectures. The problem found in the research is how to give the role to the Penitentiary of Narcotics Class IIA, Pematangsiantar so that it can be the place of the rehabilitation of drug prisoners
