- <b>ABSTRAK</b><br> Polusi udara lintas batas negara merupakan permasalahan lingkungan yang terjadi ketika polusi dari suatu negara berpindah ke negara lain. Penanganan terhadap polusi udara lintas batas negara menjadi penting karena kerugian tidak hanya terjadi di negara asal melainkan negara yang terkena dampak polusi. Polusi udara lintas batas negara terus berkembang terutama di ASEAN. Polusi asap yang disebabkan oleh kebakaran hutan dan lahan di Indonesia saat musim El Nino berpindah ke Singapura dan Malaysia dipicu oleh angin muson. ASEAN memiliki instrumen hukum ASEAN Agreement on Transboundary Haze Pollution (“AATHP”) yang mulai berlaku sejak tahun 2003. AATHP mengatur adanya pengumpulan data, pengawasan, evaluasi dan penanganan kebakaran hutan untuk mengurangi polusi asap lintas batas negara. Namun, pada praktiknya, ketentuan tersebut dirasa belum mampu melakukan pengembangan teknologi pemadaman api di hutan atau lahan yang berada di wilayah terpencil. Koordinasi dan kerja sama regional dalam penanganan polusi asap lintas batas negara juga belum optimal. Selain itu, diperlukan penegakan hukum yang memadai di tingkat nasional untuk mencegah sistem tebang bakar lahan (slash and burn); tindak lanjut bagi pelanggar, baik pelaku industri skala kecil maupun skala besar; dan adanya sosialisasi kepada masyarakat terpencil akan bahaya sistem tebang bakar lahan yang tadinya merupakan salah satu kearifan tradisional yang diakui oleh negara Indonesia. <hr> <b>ABSTRACT</b><br> Transboundary air pollution is an environmental problem that occurs when pollution moves from one country to another country. Managing and handling transboundary air pollution become important because loss does not only suffered by home country but also affected country. Transboundary air pollution has been growing continually, especially in ASEAN. Haze pollution caused by land and forest fires in Indonesia during El Nino season moved to Singapore and Malaysia triggered by monsoon. ASEAN has legal instrument named ASEAN Agreement on Transboundary Haze Pollution ("AATHP") which has came into force since 2003. AATHP has several main provis1ion namely data collection, monitoring, evaluation and handling of forest fires to reduce transboundary haze pollution. However, in practice, these provisions are still not be able to provide and develop sufficient land or forest fire fighting technology that happened in remote areas. Regional coordination and cooperation yet has not performed optimally. In addition, this also required strict law enforcement at the national level to prevent slash and burn; further investigation for offenders, both small scale industry and large scale industry; and socialization to remote communities or indigenous people about the dangers of slash and burn method that had been one of their local wisdoms that also recognized by Indonesia.
